1. General provisions

These terms set out the rules for providing services electronically and using the website at karasaki.pl (the "Service"), operated by M.K. CARE Spółka z ograniczoną odpowiedzialnością (M.K. CARE sp. z o.o.), a Polish limited liability company with its registered seat at ul. Erazma Ciołka 25/U2, 01-445 Warszawa, Poland, entered in the commercial register of the National Court Register (KRS) under no. 0000725735, tax ID NIP 5272845760, statistical no. REGON 369865240 (the "Provider"). The company operates an independent Japanese car import business under the Karasaki brand.

These terms are available free of charge at this URL in a form that allows download, replay and storage. Using the Service constitutes acceptance of these terms.

2. Definitions

  • Service — the karasaki.pl website with all its subpages, operated under the Karasaki brand.
  • Provider — M.K. CARE Spółka z ograniczoną odpowiedzialnością (M.K. CARE sp. z o.o.), seat: ul. Erazma Ciołka 25/U2, 01-445 Warszawa, KRS 0000725735, NIP 5272845760, REGON 369865240.
  • User — any person using the Service.
  • Consumer — a User who is a natural person carrying out a legal act not directly related to their business or professional activity (art. 22¹ of the Polish Civil Code).
  • Import service — a separate service consisting of intermediation in the purchase of a car from a Japanese auction, shipping, customs clearance and handover to the User. Provided under a separate agreement concluded outside the Service (email, WhatsApp, phone, in person).
  • Watchlist — local browser functionality storing listings of interest in the device memory (localStorage).

3. Scope of services provided through the Service

Through the Service we provide the following electronic services, free of charge:

  • browsing and searching listings of cars on Japanese auctions (USS, HAA Kobe, TAA, JU, BAYAUC, ARAI),
  • filtering and sorting listings by brand, model, year, price, mileage and other parameters,
  • a calculator providing an indicative estimate of vehicle import costs,
  • a local watchlist of listings,
  • access to informational content (Journal, FAQ, descriptions of the import process),
  • a contact form and contact details (phone, WhatsApp, email).

Use of the Service is free of charge. The Service charges no fees for browsing listings and does not enable purchase of a car online — all transactions take place under a separate Import service (see §6).

4. Technical requirements

To use the Service properly you need:

  • a device with internet access,
  • a current browser version (Chrome, Safari, Firefox, Edge) with JavaScript enabled,
  • an active email address (for contact, forms, alerts),
  • enabled functional cookies (storing language, currency and theme preferences).

5. Informational nature of the data

Car listings, auction prices, grade ratings, technical parameters, auction dates and locations are pulled automatically from the source system (Japanese auctions, USS/HAA/TAA networks) every 10 minutes. Despite due care they may contain errors, delays or stale data originating from the source.

Displayed prices are informational and do not constitute an offer within the meaning of art. 66 § 1 of the Polish Civil Code. The output of the import cost calculator is indicative (approximately ±5%) — the final cost depends, among other things, on currency exchange rates on the day of purchase, freight rates, customs decisions and vehicle dimensions. Only an individual price offer presented by the Provider after contact is binding for the parties.

6. Import service

The service of importing a car from a Japanese auction is not provided through the Service — it is a separate service whose scope, price and timing are agreed individually with the User (by email, phone or in person) and confirmed by a separate agreement or order confirmation.

These terms do not govern the rights and obligations of the parties to the Import service — those follow from the separate agreement and from the Polish Civil Code (mandate contract, art. 734 et seq.) and the Polish Consumer Rights Act.

7. Account, alerts and watchlist

The Service does not require account registration. The watchlist of listings and preferences (language, currency, theme) are stored in the local memory of the User's browser — clearing browser storage deletes this data irretrievably.

If you subscribed to auction alerts by providing your email address, you may opt out at any time — the opt-out link is in the footer of every message, or by contacting us.

8. Prohibited use of the Service

It is forbidden to:

  • use the Service in a way that violates the law, morality or third-party rights,
  • automatically scrape, mass-download listing data and images without our written consent,
  • bypass security measures, undertake actions aimed at destabilising the Service (DoS, intrusion attempts),
  • use Service content commercially without our consent.

9. Complaints

Complaints regarding the operation of the Service (e.g. technical errors, service unavailability, errors in displayed data) may be submitted by the User by email to biuro@karasaki.pl.

A complaint should contain contact details, a description of the problem (ideally with cause and date of occurrence) and the expected resolution. We respond within 14 calendar days. Complaints concerning the Import service are handled in accordance with the separate agreement and applicable law.

10. Liability

The Provider strives to keep the Service available without interruptions and with up-to-date data, but does not guarantee continuous availability or the error-free nature of presented information. The Provider's liability towards a User who is not a Consumer for damages arising from use of the Service is limited to actual damage, excluding lost profits. The above limitation does not apply to Consumers — towards Consumers the Provider's liability is governed by generally applicable law.

11. Intellectual property

Service content (texts, composition, layout, the Karasaki logotype, iconography, our own photographs) is protected by copyright and constitutes the Provider's property or is used under relevant licences. Copying, modifying and public distribution requires our written consent, except for permitted personal use.

Photos and descriptions of auction listings come from the Japanese auction houses and are presented for information purposes as part of the brokerage service.

12. Personal data protection

Rules of personal data processing are set out in the Privacy Policy. The Privacy Policy forms an integral part of these terms to the extent it concerns the Service.

13. Out-of-court dispute resolution

A Consumer has the option of using out-of-court methods of handling complaints and pursuing claims, including:

  • mediation conducted by the regional inspectorates of the Polish Trade Inspection (Inspekcja Handlowa),
  • proceedings before a permanent arbitration court at the regional Trade Inspection inspectorates,
  • the European Commission online dispute resolution (ODR) platform: ec.europa.eu/consumers/odr (art. 14(1) of Regulation 524/2013).

14. Changes to these terms

The Provider reserves the right to amend these terms for important reasons (changes in law, scope of services, providers, the way the Service operates). The current version is always available at this URL with the effective date shown at the top. Changes take effect on the date of publication unless the new version provides otherwise.

15. Final provisions

In matters not regulated by these terms, the provisions of Polish law apply, including the Civil Code, the Act on Providing Services Electronically, the Consumer Rights Act and the GDPR.

Disputes with Consumers are heard by the court having jurisdiction under generally applicable law. Disputes with Users who are not Consumers are heard by the court with territorial jurisdiction for the registered office of the Provider.
