Terms and Conditions of the Karasaki.pl Website – Import of Cars from Japan

§1 General Provisions
These Terms and Conditions set out the rules for providing electronic services via the Karasaki.pl website, operated by:
Rafał Karasek, conducting business under the name:
Karasaki – Import of Cars from Japan,
ul. Warszawska 8, 05-805 Otrębusy, NIP: [provide NIP],

The website allows users to:

  • View the offer of Karasaki,

  • Browse current car auctions from Japan,

  • Request car bidding on their behalf,

  • Send inquiries via the contact form.

Using the website constitutes acceptance of these Terms and Conditions.
The Terms and Conditions may be amended, and the current version is always available at www.karasaki.pl.

§2 Auction Intermediary Service
The user may browse ongoing car auctions from Japan (via integrated catalogs or subpages of Japanese auction house partners).
An interested user may request Karasaki to participate in an auction by:

  • Filling out a dedicated form,

  • Contacting by phone or email.

Bidding on behalf of the user takes place after signing a bidding order and paying a deposit specified in the agreement.
Karasaki is not responsible for the auction outcome or any changes in auction conditions imposed by the Japanese auction organizer.
The user acknowledges that cars from auctions are generally sold “as is” – without warranty – and accepts the possibility of typical vehicle wear and tear.

§3 Liability and Insurance
Karasaki acts with due diligence but is not liable for:
a) the technical condition of the vehicle due to its age or mileage,
b) transport delays beyond the company’s control,
c) acts or omissions of Japanese partners, ports, or customs agencies.

Risks related to transport (damages, delays) are covered by the carrier’s insurance or transport insurance purchased by the Client.
Karasaki is not financially liable for damages covered by an insurance policy but commits to supporting the Client in the claim process.

§4 Contact Form
Submitting an inquiry through the contact form on Karasaki.pl requires providing, at minimum: name, email address, and message content.
The user voluntarily consents to the processing of their data for contact and response purposes.
Submitting the form does not constitute a contract, only a request for an offer.

§5 Personal Data Protection (GDPR)
The personal data controller is:

Data is processed in accordance with Regulation (EU) 2016/679 (GDPR).
Processing purposes include:

  • Provision of import intermediation services,

  • Responding to inquiries sent via the contact form,

  • Marketing of own services (with voluntary consent).

Each data subject has the right to:

  • Access their data,

  • Rectify, delete, or limit processing,

  • Object to processing,

  • Data portability,

  • Lodge a complaint with the President of the Personal Data Protection Office (UODO).

Providing data is voluntary but necessary to perform services.
Data may be shared with third parties only to the extent necessary to perform the service (e.g., transport company, customs agency, insurer).
Data is not transferred outside the EEA, except where required for import from Japan – in such cases, appropriate data protection mechanisms are ensured.

§6 Final Provisions
Karasaki reserves the right to amend the Terms and Conditions – changes apply from the moment of publication.
Matters not regulated herein are governed by the Civil Code, the Act on the Provision of Electronic Services, and GDPR.
Disputes arising from the contract shall be settled by the court competent for the registered office of Rafał Karasek.
